light and no delays coming out of the macarthur maze. east bay freeways are running much lighter than usual. we're still looking at under 25 minutes drive time from the bottle to the golden gate bridge. >> a developing story and walnut creek where there is an officer involved shooting and ended with a suspect being cleat killed. will tran is live with details. >> is 330 this morning it happened and now people are saved adding to school and work. there not searching for any additional suspects they believe they have the person they were looking for. officers are still on the scene and i just got an update from the walnut creek police department. they're being aided by the concertante contra costa county sheriff's department. this happened about four hours ago when they got a

911 call from someone screaming. here is the walnut creek police captain on what happened. >> the caller was a female but i don't have any other information. there was screaming in the background there it >> were you able to locate the person who did the screening >> i do not have that affirmation. >> were there any weapons on near the suspects body? >> i cannot answer that question at this time. >> do we know if the suspect lived at the apartment complex? >> we do not know the you know if there was a child screaming? >> we do not know >> they're not telling us of the victim is a man or woman or their apartment aids. only that he or she was taken to the hospital by

ambulance so it appears that person did not die at the scene. i tried to ask the captain what made these officers feel threatened by and forced to shoot at the suspect he said he does not know and hopes to get an update about two hours from now. i will try to get information later on this morning. >> telling his story at a brentwood where pg&e crews are trying to stop a gas leak. pg&e received reports of a gas leak on all but dry. they've not been able to find the cause of the league but they say it does not appear to be spreading. there's no estimate for when the evacuating residents will be able to return home. >> for president george h. w. bush is in intensive care at a houston hospital this morning. he has been there since last month with what is being described as a stubborn fever. a spokesperson says the 88 year old is on an all liquid

"nap nanny " baby recliners. the recall covers the recliners generation 1 and 2 and the chilled model instant recliner sold between 2009 and 2012. if the recall comes after release five infants had died and dozens more have almost fallen out of the recliners. the consumer- products safety commission and warns that the nap nanny is dangerous defects in its decision and its design, instructing and warnings. the cpsc says that for retailers are voluntarily participated in the recall. >> toyota has settled the car owners over unintended acceleration in 2009 and 2010. the automaker has agreed to pay more than a billion dollars to install new safety features and

morning out of columbus, ohio. it is going to be a difficult place this morning for drivers to get to work. many roads are slick, cover with ice and snow. ohio could still pick up another injured to from the storm. the deaths from this storm toll is now up to 12 people. the storm dropped about a foot of snow and some parts of the northeast, a day after it dumped a record snowfall in arkansas and ruin the holiday travel plans from the region. and coastal areas, the storm is mostly bring in high winds and heavy rain. dozens of travelers were trying to make it home thursday after the fierce storm stranded them at airports or relatives' home or around the region. >> if your planning to make

>> new this morning. the number law enforcement officers who died while on duty have declined this year. 127 federal, state and low officers have died while performing their duties so far this year. there were 165 deaths last year and 154

in 2010. the majority of officers who died were either victims of traffic accidents or were shot. texas had the highest number of deaths at 10. followed by georgia with 8 and maryland and colorado both had this experience >> in world new lows. the victim of a brutal gang rape and new dell high has arrived in singapore for additional medical treatment, after her condition worsened. the 23 year-old woman was attacked in a new dell high bus last week. if the rape sparked widespread protests-and a government panel will be assembled to look into the crime and suggest ways to approved women's safety. >> south africa's presidency says that former president nelson mandela has been released from the hospital. the 94 year-old had been in

were fired at this apartment complex. they do not know at this point if it happens inside of the unit. this was about 3:13 a.m.. and i 11 call came in to authorities and they stated that they heard screaming in the background. officers brought in about six minutes and they received another call the shots were fired. one officer possibly to were not harmed by the gunshots. this came from one suspect so they're not looking for any additional suspects at this time. you see why this tree is a lot of people to get to their destinations. >> as far as this particular saying that will be here for some time. they continue to talk to witnesses and collect more evidence. what caused the officers to do this? >> is that if they do not know and that they will make

needs to be done if a deal is to be struck and passed through congress by the end of the year. >> sam garner stated that the government may go out of money on december 31st. he stated that the government may not have enough to spend for next month. >> approval ratings for president obama and his cabinet are mixed. a new poll shows 52 percent of people surveyed approved of the president's performance while 43 percent disapprove. but as president joe biden's numbers are in line with the president. 54 percent approve of his job performance while 40 percent do not. first lady michelle obama has a 73 percent approval rating. all going secretary of state hillary clinton is also popular with a 66 percent approval

rating. >> a new gallup poll shows a majority of americans supported stricter gun laws but most are against banning assault weapons. 58 percent of americans now say that they do support stricter gun laws. that is up from 43% in october 2011. 48% of the public say that they want to enforce current laws while 47 percent once the new legislation. the law to ban assault weapons which is backed by president obama has not gained much support since 2000 of 11 and october. 44 percent support the assault weapons ban what 51 percent are against it. >> education officials said santa cruz city schools are expected to consider a resolution next month calling for stricter national gun-control laws.

the school board's vice president is drafting a symbolic statement calling for a ban on assault weapons and high capacity ammunition nationwide. if the vice-president is also asking for greater state and federal and investment in mental health care. >> a u.s. postal service mail carrier is accused of stealing thousands of pieces of mail and giving stolen credit cards to his friends. the men pleaded not guilty to several charges of identity theft, possession of stolen property and second-degree burglary on friday. authorities said least three accomplices used the stolen credit cards. >> alameda county's of bomb squad shut down this section of oakland in an attempt to remote old at&t. if this is video from abc 7 news. some residents were evacuated after police learned someone wanted to turn in some old at&t from world war 2. the

bomb squad was called in to remove the more than 5 lbs. of the explosives. police also had to close off the 900 block of the 36 street at market. >> some mall shoppers and sacramento were set into a panic after they heard what sounded like gunshots. this was the scene yesterday shoppers ran from the art and fair mall. mall security say that the noise was actually coming from a brawl that broke out involving 20 people. officials say they found no evidence of a shooting. many stores went into lockdown, closing their metal gates when the fight started. police believe that sound so large signs falling over may have led people to report shots being fired.

gate bridge is dry. >> new this morning. u.s. consumer confidence has fallen this month driven down by fears of falling off the so-called fiscal cliff. the consumer confidence index fell to 65.1 this month down from 71.5 in november. that is the lowest level since august and outlook for the next six months has dropped to its lowest level since 2011. >> continuing to track gas prices across the bay area the average price for a gallon of regular gasoline remains at $3.60 an san francisco this morning. in the east bay the price it in oakland is $3.49 this morning. and in the south bay that average price in san jose is up 2¢ from yesterday at $3.50 a gallon. these prices compare to the

pretty good ride even though we had a few minor incidents on the peninsula. they have cleared up now and the bay bridge ride and has a light traffic and no meat during lights. the quick check commute shows we're dealing with much much lighter than usual traffic. you'll not find any of the usual commute delays. one person is dead following officer related shooting in walnut creek this morning. will tran is live on the scene. >> the contra costa county sheriff's department is also handling this investigation. i will then just a little closer to show you the complex. at around 315 a @ 8911 phone call from a woman screaming. officers came out and they found the suspect at this point they're not saying why the officers felt threatened but they shot at this person.

they are not even telling us whether this person is a man or a woman. many of the people that live here at the time were sleeping. we had a chance to talk to him and this is what he said. >> i woke up to the sound of just a loud bang sound. i did not know if it was a gunshot or someone hitting metal with a rock. that was about it. >> did you hear screaming before what you just described? >> no i was asleep. i had just woken up. >> when i saw the police tape i thought it was a joke. i saw that the police were actually here. my wife came out and she does not feel safe here now. >> this is a huge apartment complex and you can see the yellow tape stretches maybe about 300 ft. down in this direction. they're going door-to-door talking to any potential witnesses. they do

not know if the suspect was at the apartment complex but they should give us an update about 90 minutes from now. i had a chance to talk to the captain of the walnut creek police department and ask you questions including what prompted these officers to feel threatened enough to fire at these persons and their response was i do not know at this time. hopefully will get more informations. >> harry reid speaking in the last hour from the floor of the senate. he said it appears the country is headed over the so-called fiscal cliff because of lack of progress in bipartisan talks. he stressed for republicans to come up with a plan that both houses could pass and the president could sign. >> new year's eve is fast approaching and for decades and decades the american people have watched the ball drops in times square. the countdown to midnight, the start of the new year. the
